An Appeals Court Ruling Says Voters Outlawed Civil Forfeiture
The Oregon Department of Justice is scrambling to save the state’s civil forfeiture laws after the state Court of Appeals all but ruled them unconstitutional earlier this year. Kevin Jacoby, a lawyer who works on civil forfeiture cases, says the state’s going to have a tough battle. “I think they’re going to be hard pressed to convince the Supreme Court that the Court of Appeals got it wrong,” he tells WW.
